CITA Seeks Comments on DR-CAFTA "Commercial Availability" Request for Certain Flannel Fabric

The Committee for the Implementation of Textile Agreements has issued a notice requesting written comments by 11:59 p.m. EST on October 6, 2010 regarding a "commercial availability" request it received under the DR-CAFTAfrom Elder Manufacturing Company, Inc.:

  • alleging that certain woven flannel fabric classifiable under HTS subheading 5515.11.00401 cannot be supplied by the domestic industries or Costa Rica, the Dominican Republic, El Salvador, Guatemala, Nicaragua, or Honduras industries in commercial quantities in a timely manner; and
  • requesting that CITA consider allowing these fabrics to be sourced from outside the DR-CAFTA region without destroying eligibility for DR-CAFTA treatment for certain apparel.

Offers to Supply Fabrics & Rebuttal Submissions

Those parties wishing to submit a response with an offer to supply the subject fabrics or provide a rebuttal submission to a response should follow the revised procedures detailed in CITA's modified final procedures for DR-CAFTA commercial availability requests. Commercial Availability Determination due by November 4

The commercial availability investigation is projected to be completed by November 4, 2010.
