FY 2011 Refined and Specialty Sugar TRQ Opens October 1

CBP has issued a memorandum announcing the opening of the fiscal year 2011 global tariff rate quota on refined and specialty sugar, as provided for in HTS Chapter 17, Additional U.S. Note 5. This TRQ opens on October 1, 2010. The TRQ level is 7,090,000 kg (no CQE or specialty sugar certificate required), with an additional allocation of 10,300,000 kg for Canada (CQE required), and 2,954,000 kg for Mexico (CQE required).

There will be five successive openings for specialty sugar, available on a first-come, first-served basis. The dates and quota limits for these openings are as follows:

The second through fifth tranches will be reserved for organic and other specialty sugars not currently produced commercially in the U.S. or reasonably available from domestic sources.

CBP's notice lists the relevant HTS Chapters 17, 21, and 99 tariff numbers. Entries from Jordan, Singapore, Chile, Australia, Morocco, El Salvador, Honduras, Nicaragua, Guatemala, Bahrain, Dominican Republic, Costa Rica, Peru, and Oman are not subject to additional agricultural safeguard duties under HTS heading 9904, and should be presented as a type 02 entry using the high rate (over-quota) tariff number provided for in HTS Chapters 17 or 21 without the HTS Chapter 99 tariff number. Such entries must be reported through the quota module of ACS.
