CITA Seeks Comments on DR-CAFTA "Commercial Availability" Request for Certain Fabric

The Committee for the Implementation of Textile Agreements has issued a notice requesting written comments by 11:59 p.m. EST on November 10, 2010 regarding a "commercial availability" request it received under the DR-CAFTAon behalf of S. Rothschild & Co., Inc.

  • alleging that certain woven polyester/rayon/spandex fabric classifiable under HTS subheading 5407.52.2060; 5407.53.2060; 5407.61.9935; 5407.61.9955; 5407.69.2060; 5407.69.4060; 5407.72.0060; 5407.73.2060; 5407.92.2010; 5407.92.2050; 5407.93.2010; 5407.93.2050; 5512.19.0005; 5512.19.0045; 5512.99.0005; 5512.99.0040; 5515.11.0005; 5515.11.0040; 5515.12.0040; 5515.19.0005; or 5515.19.00401 cannot be supplied by the domestic industries or Costa Rica, the Dominican Republic, El Salvador, Guatemala, Nicaragua, or Honduras industries in commercial quantities in a timely manner; and
  • requesting that CITA consider allowing these fabrics to be sourced from outside the DR-CAFTA region without destroying eligibility for DR-CAFTA treatment for certain apparel.

Offers to Supply Fabrics & Rebuttal Submissions

Those parties wishing to submit a response with an offer to supply the subject fabrics or provide a rebuttal submission to a response should follow the revised procedures detailed in CITA's modified final procedures for DR-CAFTA commercial availability requests. Commercial Availability Determination due by December 10

The commercial availability investigation is projected to be completed by December 10, 2010.
