Details of Proclamation Amending HTS for Bahrain & Other FTAs, Etc.

On November 1, 2010, President Obama issued Proclamation 8596, which amends the Harmonized Tariff Schedule to implement Haiti HELP, extend the Haiti HOPE tariff preference levels, adjust the tariff classification rules (TCRs) for the U.S.-Bahrain Free Trade Agreement (BFTA), and make certain technical corrections.

This is Part III, the final part of a multi-part series of summaries of the proclamation, and covers the changes to the Bahrain FTA TCRs and certain technical corrections.

Bahrain FTA TCRs Adjusted

Proclamation 8596 contains modifications to HTS General Note 30 which adjust certain BFTA TCRs to conform to the Word Customs Organization (WCO)-recommended changes that were implemented in the HTS on February 3, 2007.

These modifications to the TCRs only affect textile and apparel articles, and are effective for goods entered or withdrawn from warehouse for consumption on or after the thirtieth day after November 4, 2010 (December 4).

The following TCRs in HTS General Note 30 have been revised:

The following TCRs in HTS General Note 30 have been deleted:

Technical Corrections to DR-CAFTA, NAFTA, Etc.

Proclamation 8596 also contains the following technical corrections to the HTS, which have various effective dates:

DR-CAFTA. HTS General Note 29(n) is modified by inserting, in TCR 25 for Chapter 84 the expression “to heading 8409" after the word “classification.” This change is effective for goods entered or withdrawn from warehouse for consumption on or after March 1, 2006.

NAFTA. Effective for goods entered or withdrawn from warehouse for consumption on or after February 3, 2007, General Note 12(t) is modified by:

  • Adding new TCRs 3A, 3B, and 3C for Chapter 86
  • Deleting the expression “tariff item 8540.12.aa” and replacing it with “tariff items 8540.12.10 or 8540.12.50" for TCRs 85(C) and 85(D) in Chapter 85, Rule 5.

Agr/hort machinery. Effective for goods entered or withdrawn from warehouse for consumption on or after February 3, 2007, HTS Chapter 98, Subchapter XVII, U.S. Note 2(u) is modified to read as follows (added text in bold, deleted text has strikethrough):

2. The provisions of headings 9817.00.50 and 9817.00.60 do not apply to:

(u) articles provided for in chapter 85 (except subheading 8519.81.20, heading 8523, subheadings 8532.90 and 8539.90, heading 8542, subheadings 8543.108543.11 through 8543.30, subheadings 8543.70.60, 8543.70.80, 8543.70.85, 8543.70.92, 8543.70.96,8543.89.93, 8543.90, 8544.70, 8546.90, 8547.20 and 8548.90);

(9817.00.50 is for machinery, equipment and implements to be used for agricultural or horticultural purposes;

9817.00.60 is for parts to be used in articles provided for in headings 8432, 8433, 8434 and 8436, whether or not such parts are principally used as parts of such articles and whether or not covered by a specific provision within the meaning of additional U.S. rule of interpretation 1(c).)
