New HTS Toy Breakouts Do Not Provide for Unlabeled Items, Changes Being Considered
The new statistical changes to the Harmonized Tariff Schedule which took effect for certain Chapter 95 toys on January 1, 2011, do not provide HTS breakouts for certain toys which are not labeled for use by a particular age group.

According to government sources, modifications to the new toy breakouts are being considered.
Jan 1 Changes Added HTS Age Breakouts for Certain Toys, Balls, Balloons, Punchballs
The January 1, 2011 changes, which were requested by the Consumer Product Safety Commission (CPSC), provided HTS breakouts at the 9th and 10th digit level under HTS 9503.00.001 to account for certain toys labeled for use by particular age groups as follows:
Inflatable toy balls, balloons and punchballs, of rubber:
9503.00.00.11 - Labeled for use by persons under 3 years of age
9503.00.00.13 - Labeled for use by persons 3 to 12 years of age
9503.00.00.15 - Labeled for use by other persons
Other:
9503.00.00.81 - Labeled for use by persons under 3 years of age
9503.00.00.83 - Labeled for use by persons 3 to 12 years of age
9503.00.00.85 - Labeled for use by other persons
Considering Modifications as Products “May Not Be Well Described”
The sources state that modifications are being considered as the products "may not be well described."
1HTS 9503.00.00 includes tricycles, scooters, pedal cars and similar wheeled toys; dolls’ carriages; dolls, other toys; reduced-scale (“scale”) models and similar recreational models, working or not; puzzles of all kinds; and parts and accessories thereof.
