BIS Expects July 'Specially Designed' Rule, Enforcement Center

At a June 14, 2011 BIS Committee meeting1, the trade discussed the Administration’s export control reform efforts with BIS. Among the issues discussed were the Administration’s efforts to define ‘specially designed’ and progress made on making the Export Enforcement Coordination Center operational.

BIS Expects to Propose ‘Specially Designed’ Definition in July Rule

BIS officials discussed the Administration’s efforts to develop an objective, understandable, and consistent definition of ‘specially designed’ to be used in the U.S. Munitions List, Commerce Control List, etc. BIS expects to include a definition of ‘specially designed’ in its upcoming proposed rule on the process the Administration will utilize to transition certain exports from the USML to the CCL (expected in July 2011).

Export Enforcement Coordination Center Building, Staffing Underway

According to BIS officials, the Administration is also proceeding with its plans for a Federal Export Enforcement Coordination Center which will serve as an information exchange for agencies involved in export enforcement. The Center, which will be located in Northern Virginia, is under construction and staffing is underway. (See ITT’s Online Archives or 11/10/10 news, 10111009, for BP summary of on the Center.)
