Details of July 1 Version of the HTS
The International Trade Commission has posted the July 1, 2011 Harmonized Tariff Schedule (Revision 1) to its website. Changes were made as a result of the 484(f) Committee, Presidential Proclamation 8682, and the U.S. termination of all 100% duties in the EU beef hormone dispute.

According to the Change Record, Revision 1 includes the following updates:
New Chapter Notes for Singapore FTA Apparel Rules, Ethyl Alcohol for Peru
Revision 1 contains the following changes that are a result of Presidential Proclamation 8682, which made amendments to the HTS to implement rules of origin changes for certain apparel under the Singapore Free Trade Agreement (SFTA), revise the tariff treatment for ethyl alcohol and ETBE from Peru, etc.:
Singapore. Revision 1 contains the new U.S. Note 2(c) to HTS Chapter 98, Subchapter XXII effective for imports from Singapore that are entered or withdrawn from warehouse for consumption on or after May 21, 2011, in order to extend SFTA duty-free treatment under HTS 9822.01.25 to certain apparel articles made in Singapore, regardless of the source of the listed yarn/fabric inputs.
Peru. Revision 1 also contains new U.S. Note 3(e) to HTS Chapter 99, Subchapter I which provides the following information regarding tariff treatment for ethyl alcohol from Peru:
(e) For purposes of headings 9901.00.50 (ethyl alcohol) and 9901.00.52 (ethyl tertiary-buytl ether (ETBE)), originating goods of Peru, under the terms of HTS general note 32 (for the PTPA1), shall not be subject to any duty provided for in such headings, provided that (i) the goods are imported directly from Peru into the customs territory of the U.S., and (ii) the sum of the cost or value of the materials produced in the territory of Peru plus the direct costs of processing operations performed in the territory of Peru is not less than 35% of the appraised value of such goods at the time they are entered.

Numbers Deleted Due to U.S. Terminating Duties in EU Beef Hormone Dispute
Certain HTS heading 9903 tariff numbers have been deleted as a result of the U.S. terminating all of the remaining 100% duty rates imposed on certain products of European Union countries in connection with the 1999 World Trade Organization rulings in the EU-U.S beef hormones dispute.

484(f) Committee Statistical Changes to Certain HTS Numbers
Changes at the statistical level (9th and 10th digits of the tariff number) that were approved by the 484(f) Committee for the following HTS Chapters have been implemented in Revision 1: 8, 17, 20, 39, 48, 72, 94, and 99. In addition, Chapter 95, Statistical Note 1 has been added as a result of the Committee’s approval.
(The 484(f) Committee is responsible for considering government and private sector requests for changes at the 9th and 10th digit level for tariff numbers, their unit of quantity, and/or description.)

(Note that the July 1 version of the HTS typically implements the Generalized System of Preferences (GSP) changes that take effect on that date; however, such changes were not included in this year’s version as GSP expired on December 31, 2010.)
