Korea Transformers: ITC Institutes Prelim AD Injury Investigation
The International Trade Commission has announced the institution of an investigation and the commencement of a preliminary phase antidumping duty injury investigation regarding large power transformers from Korea that are provided for in HTS subheading 8504.23.00.

This investigation is being instituted in response to a petition filed by ABB Inc. of Cary, NC; Delta Star Inc. of Lynchburg, VA; and Pennsylvania Transformer Technology Inc. of Cannonsburg, PA.
ITC to Determine if U.S. Industry is Injured
The ITC is instituting this investigation to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports of large power transformers from Korea that are alleged to be sold in the U.S. at less than fair value.
ITC Must Reach Preliminary Injury Determination by Aug 29
Unless the International Trade Administration extends the time for initiation, the ITC must reach a preliminary determination in AD duty injury investigations in 45 days or, in this case, by August 29, 2011. The ITC's views are due at the ITA within five business days thereafter, or by September 6, 2010.
ITA Will Initiate AD Investigation if ITC Injury Found
If the ITC preliminarily finds injury, the ITA will initiate its investigation to determine whether there is dumping, and if so, the margin of dumping.
