Reminder: Comments on EU Dual-Use Export Reform Proposals due Oct 31

In June 2011, the European Commission issued a Green Paper seeking comments by October 31, 2011 on how the European Union's system of export controls should be administered for dual-use goods (items that have both military and civilian uses).

The EC notes that dual-use items account for up to 10% of EU exports.

EC Seeks Input to Prepare Export Control Reform Strategy

The EC states that this consultation is being conducted to gather input on: (i) the detailed provisions of the current export control framework in order to prepare a review of the system; and (ii) the progressive reform of the EU dual-use export control system in order to adapt it to changing circumstances of the modern world.

The results of the consultation will help the EC create concrete amendments to the system and prepare a long term strategy on the development of export controls in the EU.

Seeks Comments on Competitiveness, Customs Info, AEO Status, Etc.

Among other things, the EC seeks comments on:

  • How competitive EU dual-use exporters are as compared to exporters from third countries.
  • What type of information would customs authorities need to properly enforce export controls at EU borders.
  • How the Authorized Economic Operator (AEO) status could be used within the export control framework.

Report to be Issued in 2012, Regulatory Proposals in 2013-14

The EC will report the results of the consultation in early 2012. Proposals to amend its Dual-Use Regulation are due in 2013 - 2014.
