ITC Votes to Institute Patent Case on Smartphones & Tablets Against Apple, RIM
The International Trade Commission has voted to institute a section 337 patent-based investigation of certain devices for mobile data communication (337-TA-809). The products at issue are tablet computers, and smartphones. The investigation is based on a complaint filed by Openwave Systems, Inc., Redwood City, CA on August 31, 2011.

The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the U.S. and sale of these products and requests an ITC exclusion order and cease and desist orders. Apple Inc. of Cupertino, CA; Research in Motion Ltd. of Canada; and Research in Motion Corp. of Irving, TX are listed as the respondents in this investigation. RIM makes the BlackBerry.
