1st Tranche of Specialty Sugar TRQ Oversubscribed at Opening Moment

U.S. Customs and Border Protection has issued a memorandum announcing that the first tranche for the fiscal year 2012 specialty sugar tariff rate quota (TRQ) that opened on October 12, 2011 oversubscribed at opening moment. The pro rata percentage is 29.46292% or 0.29462928.

Entries or withdrawals for consumption for specialty sugar presented after the opening should be returned to the broker for amendment. To facilitate release of shipments, HQ Quota will not allow filers to re-transmit amended entries. Filers should submit corrected CBP Form 7501s, and the ports will update the entry summary line information. It may be necessary to add lines in order to accurately reflect the amendment.

The importer has the option to distribute the prorated allocation on a given entry (i.e., more or less than the prorated amount, or none at all). The importer may also transfer the allotment to entries at another port. However, in any of these scenarios, the importer may not enter more than the total prorated amount that was properly presented at opening.

(The U.S. Department of Agriculture has previously stated that the FY 2012 specialty sugar TRQ will be administered on a first-come, first-served basis, in five tranches with the first opening on October 12, 2011, the second opening on October 26, 2011; the third opening on January 11, 2012; the fourth opening on April 11, 2012; and the fifth opening on July 11, 2012.)
