CBP Posts January 2011 TRQ Results "Late" for Milk & Cream, Dairy Products
U.S. Customs and Border Protection has posted two memoranda dated January 11, 2011 announcing the results of the tariff-rate quotas (TRQs) for milk and cream, condensed or evaporated, and for dairy products, which opened on January 3, 2011. CBP sources state that these memoranda went out to the field and trade in January 2011 but were never posted online.

2011 TRQ for Milk & Cream, Condensed or Evaporated, Did Not Oversubscribe
The TRQ for milk and cream, condensed or evaporated, provided for in Chapter 4, Additional U.S. Note 11 of the Harmonized Tariff Schedule (HTS) opened on January 3, 2011. The minimum access quantity (MAQ) for condensed milk in airtight containers was not satisfied for any of the countries.

2011 TRQ for Dairy Products also Did Not Oversubscribe at Opening
The TRQ for dairy products, provided for in Chapter 4, Additional U.S. Note 10, of the HTS, which opened on January 3, 2011, did not oversubscribe at the opening. The minimum access quantities were not reached for any of the countries/commodities.
When a minimum access quantity limit has been reached, the in-quota rate for "Any Country" may be used until the balance is exhausted. Therefore, all entries presented at opening have been charged and may be released and the in-quota rate is still available on a first-come, first-serve basis until the balance is exhausted.
