ITC Votes to Institute Patent Case on Computing Devices with Instructions/Software Against Apple

The International Trade Commission has voted to institute a section 337 patent-based investigation of certain computing devices with associated instruction sets and software (337-TA-812). The products at issue in this investigation are microprocessor-based electronic devices, such as portable electronic devices and digital media receivers.

The investigation is based on a complaint filed by VIA Technologies, Inc., of Taiwan; IP-First, LLC, of Fremont, CA; and Centaur Technology, Inc., of Austin, TX, on September 22, 2011. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain computer devices with associated instrument sets and software that infringe patents asserted by the complainants. The complainants request that the ITC issue an exclusion order and a cease and desist order. The ITC has identified Apple Inc., a/k/a Apple Computer, of Cupertino, CA, as the respondent in this investigation.
