EPA Reminds Trade CPSC Has Access to TSCA Submissions & CBI
The Environmental Protection Agency has issued a notice to remind interested parties that under a 1986 Memorandum of Understanding with the Consumer Product Safety Commission, EPA provides CPSC access to information which has been submitted to EPA under all sections of the Toxic Substances Control Act, some of which may be Confidential Business Information (CBI).

CPSC Staff Must Sign Nondisclosure Agreement, Follow CBI Protocols, Etc.
According to EPA, the access to TSCA CBI is provided on a “need to-know” basis only, and CPSC staff must adhere to all provisions of EPA’s TSCA CBI Protection Manual, sign a nondisclosure agreement, and are briefed on appropriate security procedures before they are permitted access.
