China Wood Flooring: Details of AD Duty Order, 90 Revised Rates

The International Trade Administration has issued an amended final determination and antidumping duty order on multilayered wood flooring from China (A-570-970), which among other things amends the rates for 90 respondents. The order also details a "gap period" of November 23 - December 6 of no AD duty liability due to the expiration of the provisional measures period. This order is effective December 7, 2011, and is expected to be implemented by U.S. Customs and Border Protection soon.

Gap Period of No AD Suspension of Liq or AD Duties for Nov 23-Dec 6

For this investigation, the six month provisional measures period for which the AD suspension of liquidation may remain in effect before the order is issued began on May 26, 2011 (the publication date of the preliminary determination) and ended on November 22, 2011.

As the International Trade Commission's final affirmative injury determination was published on December 7, 2011, the ITA is instructing CBP to terminate the AD suspension of liquidation and to liquidate, without regard to AD duties, unliquidated entries of subject merchandise from China with a time of entry on or after November 23 through December 6, 2011 (the gap period). (For entries with a time of entry on or after May 26, 2011 through November 22, 2011, suspension of liquidation and AD duty liability remains in effect.)

AD Suspension of Liq Instructions

Suspension of liquidation resumes for all entries of subject merchandise from China with a time of entry on or after December 7, 2011, the date that the final ITC affirmative injury determination was published, except for Yuhua as exporter and producer; Yuhua has been excluded from the investigation (and is now excluded from the order) due to its zero AD rate.

AD Cash Deposit Instructions

An AD cash deposit requirement is also in effect for subject merchandise from China with a time of entry on or after December 7, 2011.

The ITA will instruct CBP to require, at the same time as importers deposit estimated duties, a cash deposit equal to the AD duty rates1 listed below (which are revised for Layo Wood (from 3.98%) and the 89 separate rate respondents (from 3.31%)), and excluding Yuhua as exporter and producer, for all entries of subject merchandise from China with a time of entry on or after December 7, 2011, as follows:

Scope of Order Amended

The scope of the order has been amended to eliminate references to 14 “additional” Harmonized Tariff Schedule numbers. (In the AD final determination, ITA inadvertently left these numbers in; however the scope was accurately depicted in the companion CV final determination.)
