CBP NY/Newark Info on Requesting Refunds When Entries Deleted/Canceled

U.S. Customs and Border Protection for Field Operations at the Port of New York/Newark has issued an Informational Pipeline to provide instructions to the importing community on how to obtain relief through the administrative refund process at the time of request for the deletion/cancellation of an entry. According to the Pipeline, PEAs will not be accepted for this process.

Port Provides Further Guidance on Administrative Refund Process

On May 5, 2008, the New York Field Office issued Informational Pipeline 08-005 regarding deletion/cancellation procedures for ABI certified entries. The Port has issued this 2012 Pipeline in order to provide further instructions to the importing community on how to obtain relief through the administrative refund process at the time of deletion/cancellation request as referred to in its previous pipeline. The Port advises that the policy and procedures set forth in its previous pipeline have not changed and are still in effect.

If Entry Deletion/Cancellation Request Approved, Importer Will be Refunded

All requests for entry deletion/cancellation must be submitted on company letterhead, in duplicate, to the appropriate Entry Specialist Team (EST) at the Ports of JFK or New York/Newark. If the entry was previously paid, then the entry deletion/cancellation request should also include a request for a refund, if appropriate. The refund request should include the amount of money to be refunded, which should match the amount paid. If the deletion/cancellation request is approved by the reviewing EST, any duties, taxes or fees owed the importer will be refunded before the entry is canceled or deleted by CBP.

PEAs May Not Be Submitted to Request Deletion/Cancellation & Refunds

A Post Entry Amendment (PEA) may not be submitted to request deletion/cancellation and subsequent refund of duties, taxes and fees. Any such requests will be returned to the filer. CBP has posted general information regarding PEAs here.
