China Steel Wheels: Final AD/CV Determination Announced

The International Trade Administration has issued a fact sheet announcing its affirmative final determinations in the antidumping and countervailing duty investigations of certain steel wheels from China (A-570-973, C-570-974), its finding of AD critical circumstances for one company and the China-wide entity, and its finding of CV critical circumstances for all other Chinese producers/exporters.

Final AD Rates Range from 44.96% to 193.84%

As a result of the final AD determination, the ITA will instruct CBP to continue to collect cash deposits or bonds equal to the AD margins of 44.96% to 193.54% (8 separate rate respondents received a margin of 63.94%, and the China-wide entity received a rate of 193.54%), adjusted for export subsidies found in the final determination of the CV investigation.

As the ITA found critical circumstances in the AD investigation with regard to the China-wide entity, and because the ITA did not find critical circumstances for the China-wide entity at the preliminary determination, they will direct U.S. Customs and Border Protection (CBP) to suspend liquidation of merchandise exported by the China-wide entity effective 90 days prior to the publication of the preliminary determination (i.e., on or about August 4, 2011)..

Final CV Rates Range from 25.66% to 38.32%

The final CV determination has found rates of 25.66% to 38.32% (the ITA found an all-others rate of 34.55%). As a result of the affirmative CV determination, the ITA will issue a CV duty order, reinstate the suspension of liquidation, and require a cash deposit equal to the final rates if the International Trade Commission (ITC) makes a final affirmative injury determination.

ITC to Issue Final Injury Determination in April 2012

The ITC is currently scheduled to issue its final injury determination on or before April 30, 2012. If the ITC makes an affirmative determination that imports of steel wheels from China materially injure, or threaten material injury to, the domestic industry, the ITA will issue AD and CV duty orders.
