UAE Steel Nails: AD Rates Reduced for Most in Final Determination
The International Trade Administration has issued its final affirmative antidumping duty determination on certain steel nails from the United Arab Emirates (A-520-804), which reduces the AD rates for two firms and “all-others”, and increases the AD rate for one firm. This final determination, which is effective March 23, 2012, is expected to be implemented by U.S. Customs and Border Protection soon.

Scope of Investigation Unchanged
The ITA states that, as no interested parties submitted comments relating to the scope since the preliminary determination, this final determination adopts the revisions to the scope discussed in the preliminary determination.1
Suspension of Liquidation Continues
The ITA is directing CBP to continue to suspend liquidation of all imports of subject merchandise which were entered, or withdrawn from warehouse, for consumption on or after November 3, 2011 (the publication date of the preliminary determination).
Estimated AD Cash Deposit/Bond Rates Revised
The ITA will instruct CBP to require an AD cash deposit or the posting of a bond, for all imports of subject merchandise which were entered, or withdrawn from warehouse, for consumption on or after March 23, 2012, equal to the following revised AD rates:

1In the preliminary determination, the ITA removed the language referring to packaging characteristics of certain nails excluded from the scope, and modified the scope to reflect the ASTM Standard F (2011 revision) instead of the 2005 revision.
2Tech Fast International Ltd. was assigned this rate due to the ITA’s application of adverse facts available. According to the ITA, Tech Fast failed to provide requested information. Therefore, the ITA assigned it the highest rate included in the petition underlying this investigation.
