Brazil Orange Juice: Prelim Results of AD Admin Review

The International Trade Administration issued the preliminary results of its administrative review of the antidumping duty order on certain orange juice from Brazil (A-351-840) for four companies1. These preliminary results are not in effect. The ITA may modify them in the final results of this review and change the estimated AD cash deposit rate for these companies.

ITC Voted to Revoke the AD Order on Orange Juice from Brazil

As a result of the ITC's determination that revocation of the AD order on certain orange juice from Brazil would not be likely to lead to a continuation or recurrence of material injury within a reasonably foreseeable time, the ITA will soon publish a notice revoking the AD order. However, as revocation of this order will be effective 5 years from the date of the AD order (i.e., approximately March 9, 2011), and this review period covers entries before the effective date of revocation, the ITA will continue this administrative review, and entries of subject merchandise prior to the effective date of revocation will still be subject to AD suspension of liquidation, AD cash deposits, and assessment of AD duties.

1The ITA found that one of these four companies, Montecitrus Trading S.A., did not export merchandise to the U.S. during the period of review, and as such the ITA preliminarily found that Montecitrus did not have any reviewable transactions. However, the ITA has decided not to rescind the review, but rather to instruct CBP to liquidate any existing entries of merchandise produced by Montecitrus, and exported by other parties, at the all-others rate, complete the review for Montecitrus, and issue the appropriate instructions to CBP based on the final results of the review.

2The ITA has preliminarily found that Louis Dreyfus is the successor-in-interest to Coinbra Frutsep and, as a consequence, the ITA finds Louis Drefus' U.S. sales of frozen concentrated orange juice would be subject merchandise in this proceeding.
