China Kitchen Appliance Shelving & Racks: Final Results of CV Admin Review
The International Trade Administration has issued the final results of an administrative review of the countervailing duty order on certain kitchen appliance shelving and racks from China (C-570-942). The final results set CV cash deposit rates for seven producer/exporters. These rates, which are effective April 11, 2012, are expected to be implemented by U.S. Customs and Border Protection soon.

Assessment of CV Rates to Differ for Oven Racks and Refrigeration Shelving
The ITA intends to issue appropriate assessment instructions to CBP 15 days after publication of these final results, as follows:
Oven Racks: For certain oven racks from China entered, or withdrawn from warehouse for consumption from September 9, 2009 through December 31, 2009, the ITA will instruct CBP to assess CV duties at the rates applicable to each company shown above and to liquidate such entries. Entries of certain oven racks occurring before September 9, 2009, were already liquidated at the time of the CV order due to the International Trade Commission's finding of threat of material injury on certain oven racks.
Refrigeration Shelving: For certain refrigerator shelving from China entered, or withdrawn from warehouse, for consumption from January 7, 2009, through May 6, 2009, and September 9, 2009, through December 31, 2009, the ITA will instruct CBP to assess CV duties at the rates applicable to each company shown above and to liquidate such entries. Entries of certain refrigeration shelving occurring during the period May 7, 2009, through September 8, 2009, were not suspended for CV purposes due to the termination of provisional measures.
1This rate is a result of the ITA's application of adverse facts available (AFA). According to the ITA, Asia Pacific and Weixi were non-cooperative because they did not provide a response to the ITA's initial quantity & value questionnaire.
