ITC Rescinds LEO & C/D Orders on Semiconductors w/ Synchronous DRAM Controllers

The International Trade Commission rescinded a limited exclusion order and cease and desist orders in its section 337 patent investigation of certain semiconductor chips having synchronous dynamic random access memory controllers and products containing same (337-TA-661), on the basis of a settlement agreement and a Court of Appeals for the Federal Circuit remand.

LEO and C/D Orders Issued in July 2010

On July 26, 2010, the ITC, pursuant to a complaint filed by Rambus, Inc. of Los Altos, CA that alleged a violation of section 337 in the infringement of certain patents, issued a limited exclusion order and cease and desist orders against respondents: NVIDIA Corp., Santa Clara, CA; Hewlett-Packard Co., Palo Alto, CA; ASUS Computer International, Inc., Taiwan; Palit Multimedia Inc., Canada; Palit Microsystems Ltd., Taiwan; MSI Computer Corp., City of Industry, CA; Micro-Star International, Taiwan; EVGA Corp., Brea, CA; DiabloTek, Inc., Alhambra, CA; Biostar Microtech Corp., City of Industry, CA; and BFG Technologies, Inc., Lake Forest, IL.

Orders Rescinded on Basis of Settlement Agreement, CAFC Remand

The ITC said Rambus and NVIDIA have since settled their patent dispute, and on February 10, 2012, jointly moved to rescind the Commission’s remedial orders on the basis of settlement. No oppositions were filed. In addition, on April 3, 2012, CAFC dismissed the last remaining appeal of the ITC determination, in an order that remanded the appeal to the ITC with instructions to vacate the exclusion orders at issue in this appeal. The ITC therefore determined to rescind the exclusion order and cease and desist orders.
