Modified Australia FTA Rayon Yarn Rule of Origin Effective June 1
Certain modifications to the product-specific rules of origin for yarns of viscose rayon fiber under the U.S.-Australia Free Trade Agreement (USAFTA) will take effect June 1, 2012, said the U.S. Trade Representative, following notification by the government of Australia on March 15 that it had completed its applicable domestic procedures to give effect to the changes. Furthermore, USTR announced a correction to the modified rules of origin.

Modification for Viscose Rayon Fiber Yarn in Effect June 1
The Proclamation's USAFTA tariff classification rule (TCR) changes for certain yarns of viscose rayon fiber are implemented in the HTS for Chapter 55, effective for goods entered or withdrawn from warehouse for consumption on or after June 1, 2012, as follows:
1. A change to subheadings 5501.10 through 5510.301 from any other chapter, except from headings 5201 through 5203 or 5401 through 5405.
1A. A change to subheading 5510.90 from subeading 5504.10 or from any other chapter, except from headings 5201 through 5203 or 5401 through 5405
1B. A change to heading 5511 from any other chapter, except from headings 5201 through 5203 or 5401 through 5405
(Prior to this June 1 change, TCR 1 for Chapter 55 stated "a change to headings 5501 through 5511 from any other chapter, except from headings 5201 through 5203 or 5401 through 5405." Sources at the ITC said that the effect of the above changes are to "pull out" subheading 5510.90 from the former rule encompassing all of headings 5501 through 5511. Therefore, the Proclamation creates a new TCR 1A for viscose rayon fiber under 5510.90, while maintaining the prior TCR 1 for all other articles contained in subheadings 5501.10 through 5510.30, as well as for all articles in heading 5511, in new TCRs 1 and 1B, respectively.)
1TCR 1 for Chapter 55 was originally incorrect in Proclamation 8334, and said "a change to subheadings 5501.00 through 5510.30" (note the USTR notice mischaracterized the proclamation's error as "a change to subheadings 5501.00 through 5501.30").
