BIS Adds 8 Persons to Entity List, Removes 13, Amends 36 Entries

The Bureau of Industry and Security issued a final rule, effective Sept. 19, to amend the Export Administration Regulations by adding six persons from the United Arab Emirates and Iran to the Entity List and remove one person from the Entity List. This rule also removes 14 entries from the Entity List, adds 3 entries to the Entity List, and amends 36 entries to provide alternate addresses, alternate spelling of names, etc. on the basis of the BIS End-User Review Committee’s (ERC) annual review of the Entity List for 16 countries.1

(The persons being added to the Entity List have been determined by the U.S. government to be acting contrary to the national security or foreign policy interests of the U.S. Persons can include companies or individuals.)

Eight Persons Added to Entity List in Ten Entries; One Entry for Alternate Address

This rule amends the EAR (15 CFR Part 744) by adding the following six persons to the Entity List in eight entries:

Iran

For the six persons added to the Entity List, the End User Review Committee (ERC) specified a license requirement for all items subject to the EAR and established a license application review policy of a presumption of denial. The license requirement applies to any transaction in which items are to be exported, reexported, or transferred (in-country) to such persons or in which such persons act as purchaser, intermediate consignee, ultimate consignee, or end-user. In addition, no license exceptions are available for exports, reexports, or transfers (in-country) to those persons being added to the Entity List.

This rule also amends the Entity List on the basis of the ERC’s annual review by adding two entries for China and one entry for Uganda.

China

Uganda

The two additions for China were formerly aliases of the Chinese Academy of Engineering Physics, and the entry for Uganda is an alternate address for Allied Trading Co. of Pakistan. Licensing requirements for the three new entries will not change: the two Chinese entries will require licenses for all items subject to the EAR and be subject to a case-by-case license review policy, as is the case for the Chinese Academy of Engineering Physics; the Uganda entry will require licenses for all items subject to the EAR and be subject to a license review policy of denial, as is the case for Allied Trading Co.

15 Persons Removed from Entity List, but Two Still Subject

BIS also removed one person from the Entity List as a result of the person’s request for removal from the Entity List:

The two entities from Kuwait removed from the Entity List are also listed in the U.A.E. BIS said it is not removing the two U.A.E. listings from the Entity List at this time, and will evaluate those entries as part of the annual review of U.A.E. entries.

On the basis of decisions made by the ERC during the annual review, this rule amends 36 entries currently on the Entity List to provide alternate addresses, alternate spellings for the names of listed persons, and/or aliases, as follows:

Savings Clause

Shipments of items removed from eligibility for a License Exception or export or reexport without a license (NLR) as a result of this regulatory action that were on dock for loading, on lighter, laden aboard an exporting or reexporting carrier, or en route aboard a carrier to a port of export or reexport, on Sept. 18, 2012, pursuant to actual orders for export or reexport to a foreign destination, may proceed to that destination under the previous eligibility for a License Exception or export or reexport without a license (NLR).
