BIS Adds 2 Pakistan Persons, Revises 1 UAE Entry on Entity List

The Bureau of Industry and Security issued a final rule, effective Sept. 19, to amend the Export Administration Regulations by adding two persons from Pakistan to the Entity List and modifying one existing entity from the United Arab Emirates. The rule also corrects citations in part 744 of the EAR to reflect the most recent Continuation of the National Emergency with Respect to Weapons of Mass Destruction, issued Nov. 1. The persons being added to the Entity List have been determined by the U.S. government to be acting contrary to the national security or foreign policy interests of the U.S. Persons can include companies or individuals.

Two Persons Added to Entity List

This rule amends the EAR (15 CFR Part 744) by adding the following two persons to the Entity List that BIS determined to be assisting violent extremist organizations that use Improvised Explosive Devices (IEDs) in Afghanistan and Pakistan:

Pakistan

  • Azam Electronics (a.k.a. Mohammad Azam Electronics; Akram Dish TV Satellite Center)
  • Mohammad Azam (a.k.a. Mohammad Akram)

For the two persons added to the Entity List, the End User Review Committee (ERC) specified a license requirement for all items subject to the EAR and established a license application review policy of a presumption of denial. The license requirement applies to any transaction in which items are to be exported, reexported, or transferred (in-country) to such persons or in which such persons act as purchaser, intermediate consignee, ultimate consignee, or end-user. In addition, no license exceptions are available for exports, reexports, or transfers (in-country) to those persons being added to the Entity List.

One Entry Revised to Provide Alternate Alias, Address

This rule amends one UAE entry currently on the Entity List to provide an alternate alias and address.

Savings Clause

Shipments of items removed from eligibility for a License Exception or export or reexport without a license (NLR) as a result of this regulatory action that were on dock for loading, on lighter, laden aboard an exporting or reexporting carrier, or en route aboard a carrier to a port of export or reexport, on Sept. 18, 2012, pursuant to actual orders for export or reexport to a foreign destination, may proceed to that destination under the previous eligibility for a License Exception or export or reexport without a license (NLR).
