World Trade Organization Notices for Feb. 7-8

  • Solar panel dispute. The U.S. requested consultations with India on certain measures of India relating to domestic content requirements for solar cells and solar modules. The U.S. claims India requires solar power developers to buy and use domestic solar cells and solar modules in order to benefit from participating in a special program, which could include contracts with and subsidies on electricity rates from the National Power Company. Consultations are the first step in the dispute process. If after 60 days consultations fail, a formal dispute panel may be requested. (here)
  • Energy dispute panel reports appealed. Canada filed a notice of appeal in dispute cases “Certain Measures Affecting the Renewable Energy Generation Sector,” complaint by Japan (DS412) and “Measures Relating to the Feed in Tariff Program,” complaint by the EU (DS426). Each appeal is heard by three members of a permanent seven-member Appellate Body comprising persons of recognized authority and unaffiliated with any government. (here)
