Oil Country Tubular Goods from Nine Countries: New AD/CVD Investigations Deadlines & Scope

The Commerce Department issued Federal Register notices on its recently initiated antidumping investigations on oil country tubular goods from India, South Korea, Philippines, Saudi Arabia, Taiwan, Thailand, Turkey, Ukraine, and Vietnam (A-533-857, A-580-870, A-565-802, A-517-804, A-583-850, A-549-832, A-489-816, A-823-815, A-552-817) and countervailing duty investigations on oil country tubular goods from India and Turkey (C-533-858, C-489-817). The agency will determine whether imports of oil country tubular goods from these countries are being, or are likely to be, sold in the U.S. at less than fair value, and whether imports from these countries are being illegally subsidized.

The AD period of investigation for Vietnam is Jan. 1, 2013, through June 30, 2013. The AD period of investigation all other investigated countries is July 1, 2012, through June 30, 2013. The CVD period of investigation for India and Turkey is Jan. 1, 2012, through Dec. 31, 2012.

AD/CVD Respondent Selection

Commerce said it will rely on CBP data to pick the respondents for the CVD investigations and for all of the AD duty investigations except for Vietnam. Comments on the CBP data and respondent selection are due by July 31. Commerce said it will pick respondents to the investigations by Aug. 13.

For Vietnam, the agency will issue quantity and value questionnaires to potential respondents identified in the petition, and base its respondent selection on the responses.

Scope of the AD/CVD Investigations

"The merchandise covered by the investigations is certain oil country tubular goods (“OCTG”), which are hollow steel products of circular cross-section, including oil well casing and tubing, of iron (other than cast iron) or steel (both carbon and alloy), whether seamless or welded, regardless of end finish (e.g., whether or not plain end, threaded, or threaded and coupled) whether or not conforming to American Petroleum Institute (“API”) or non-API specifications, whether finished (including limited service OCTG products) or unfinished (including green tubes and limited service OCTG products), whether or not thread protectors are attached. The scope of the investigations also covers OCTG coupling stock.

"Excluded from the scope of the investigations are: casing or tubing containing 10.5 percent or more by weight of chromium; drill pipe; unattached couplings; and unattached thread protectors.

"The HTSUS subheadings above are provided for convenience and customs purposes only. The written description of the scope of the investigations is dispositive."

Comments on Scope Due by Aug. 12

Commerce said it discussed the scope with petitioners to ensure that it is an accurate reflection of the products for which the domestic industry is seeking relief. Comments on the scope are due by Aug. 12.
