BIS Amends CCL, EAR to Reflect Recent Changes Made Through Australia Group

The Commerce Department’s Bureau of Industry and Security (BIS) issued a final rule to amend the Commerce Control List (CCL) entry in the Export Administration Regulations (EAR) that controls equipment capable of handling biological materials, along with other changes, to reflect an understanding reached at the 2013 Australia Group meeting and an intercessional Australia Group meeting in 2012. The Australia Group is an informal coalition of more than 40 nations (here). This final rule also amends the CCL entry that controls certain animal pathogens, and the rule amends the EAR to add Mexico as a participating country in the Australia Group.

Furthermore, this rule adds a License Exception Strategic Trade Authorization paragraph to the CCL that controls human and zoonotic pathogens and toxins. This rule also implements recommendations agreed to on changes to Clostridium perfringens in the Australia Group “List of Biological Agents for Export Control” and changes to the description of “genetic elements,” which are included in three of the Australia Group common control lists. Finally, this rule amends the EAR to add Somalia and Syria as States Parties to the Chemical Weapons Convention. This final rule is effective on March 26.
