Industry Coalition Targets ECR Licensing Management Reforms

The Obama administration should focus on licensing management reforms as it continues to forge ahead with Export Control Reform (ECR), said the Coalition for Security and Competitiveness in an April 11 letter to President Barack Obama. The 18 organizations that make up the coalition commended the ECR efforts to date, but expressed concern that the administration’s increased attention towards cloud computing, record keeping, cyber security, and encryption may lead to more controls on dual-use items. The Commerce and State departments are continuing to transfer dual-use items from the U.S. Munitions List to the Commerce Control List (see 14030504). The coalition recommended the following specific licensing management reforms:

  • “A workable comprehensive licensing framework covering technology sharing with friends and allies on the government’s own priority defense and security programs, as well as enhanced license exemptions for exports that support U.S. government, military, and intelligence activities abroad.”
  • “An effective and efficient intra-company transfer license that allows trusted companies to exchange technology freely within their own organizations across the globe protected by internal compliance processes as well as technology and intellectual property controls.”
  • “Simplified and recalibrated encryption controls that subject only a narrow positive list of encryption-related items to control.”
  • “Completion of the effort within the Defense Department to consolidate technology review boards and revise their mission for clarity, consistency, transparency, and timeliness in line with the Administration’s drive for defense acquisition reform.”
