Commerce, State Schedule More Export Control Moves in Spring 2014 Regulatory Agenda

The Commerce and State Departments released their respective spring 2014 regulatory agendas for the 2014 calendar year. The Commerce Department’s Bureau of Industry and Security (BIS) and the State Department say they are planning several more rules related to export control reform, including more rules to transfer items from the U.S. Munitions List to the Commerce Control List and a clarification of U.S. principal party in interest responsibilities in routed export transactions.

In conjunction with State, BIS intends to propose the following export control reform rules during the remainder of FY 2014, along with other changes:

In its own regulatory agenda, State said it plans to propose rules for USML Categories I (here), II (here), III (here), XII (here) and XIV (here), along with USML XVIII (Directed Energy Weapons) (here).

The agenda also identifies the final rules BIS intends to finalize during the remainder of 2014. According its regulatory agenda, BIS intends to finalize the following rules:

In the separate agenda, State released also plans to finalize transfers for USML Categories XI (here) and XV (here).

Other Upcoming BIS Rules:

Among other rules planned for proposal, BIS intends to amend by June in a final rule the Export Administration Regulations (EAR) to impose controls on read-out integrated circuits, seismic intrusion detection systems, radar for helicopter autonomous landing systems and technology required for the development or production of specified nanotechnology (here). BIS is targeting by August a final rule to clarify U.S. principal party in interest responsibilities in routed export transactions (here). BIS also aims by September to finalize revisions to the EAR to implement components of a bilateral understanding between the U.S. and India related to exports and reexports (here).

Other Upcoming State Rules:

Among other rules planned for proposal, State is targeting by June updates to the International Traffic in Arms Regulations regarding replacement parts and components. This final rule would eliminate the requirement for a license for replacement parts and components for systems or end items approved in a previous license (here). State also intends to issue an interim final rule by December to establish procedures addressing how individuals and entities can request reconsideration of their sanctioned status pursuant to certain sanction programs administered by the State Department related to Iran, weapons proliferation, and terrorism (here).
