BIS Asks for Comments on Potential Changes to Export Clearance

The Commerce Department’s Bureau of Industry and Security is asking industry for comments on a potential proposal to revise and improve export clearance requirements in order to, in part, harmonize Export Administration Regulations with the International Traffic in Arms Regulations. This advanced notice of proposed rulemaking aims to build on regulatory harmonization through Export Control Reform. The prospective changes would impact regulations under EAR part 758. BIS is asking for comments on the following specific revisions under consideration at the agency:

  • A requirement that all Export Control Classification Numbers are identified on all Commerce Control List items, with the exception of EAR99 goods.
  • A requirement that all export control documents include the country of ultimate destination. Most export documents already contain country of ultimate destination information, BIS said.
  • A requirement that all export control documents contain the license number, license exception code or no license requirement destination.
  • A requirement that all exports to Canada of goods controlled for national security, missile technology, nuclear nonproliferation and chemical and biological weapons reasons must be filed through the Automated Export System.

BIS is also asking for any additional comments on ways to improve export clearance requirements. Stakeholders may submit comments by July 6 through mail, publiccomment@bis.doc.gov (RIN 0694-AG51 in the subject line) and www.regulations.gov (identification number BIS-2015-0012).
