Coalition Seeks New AD Duties on Ferrovanadium From South Korea

The Vanadium Producers and Reclaimers Association filed a petition on March 28 with the Commerce Department and International Trade Commission asking new antidumping duties on ferrovanadium from South Korea. The coalition of four domestic manufacturers alleges antidumping duties on ferrovanadium from China have resulted in an almost complete stop in that country's exports to the U.S., but that Chinese companies are getting around those duties by selling raw materials to South Korean companies that then sell in the U.S. at less than fair value.

Proposed Scope

All ferrovanadium regardless of grade (i.e., percentage of contained vanadium), chemistry, form, shape, or size. Ferrovanadium is an alloy of iron and vanadium that is used chiefly as an additive in the manufacture of steel. The merchandise is commercially and scientifically identified as ferrovanadium. The requested scope specifically excludes vanadium additives other than ferrovanadium, such as nitrided vanadium, vanadium aluminum master alloys, vanadium chemicals, vanadium oxides, vanadium waste and scrap, and vanadium-bearing raw materials such as spent hydrotreating and hydrorefining catalyst, slag, boiler residues and fly ash. Merchandise properly classified under Harmonized Tariff Schedule of the United States (“HTSUS”) item numbers 2850.00.2000, 8112.92.7000, and 8112.99.2000 is specifically excluded. Ferrovanadium is classified under HTSUS item number 7202.92.0000. Although these HTSUS item numbers are provided for convenience and Customs purposes, the written description of the requested scope of this investigation is dispositive.

Commerce Accepting Comments on Petition Support

The Commerce Department is accepting comments on domestic industry support for the petitions to determine whether the petitions meet the dual requirements of support by domestic producers or workers accounting for (1) at least 25% of the total production of the domestic-like product and (2) more than 50% of the production of the domestic-like product produced by that portion of the industry expressing support for, or opposition to, the petition. If the petitions meet these requirements, among others, Commerce will initiate an antidumping duty investigation that could lead to a permanent antidumping duty order. Comments are due by April 18.
