Nutricia North America on the classification of gastrointestinal, metabolic, metabolic PKU and neurology products. CBP classified the merchandise under subheading 2106.90.9998 (6.4%). Jiangsu Tiangong Tools Company Limited challenging the Commerce Department's refusal to accept its quantity and value questionnaire, and assign the company its own rate (instead of the China-wide rate), in the antidumping duty investigation on carbon and alloy steel cut-to-length plate from China. #16-00140. Filed July 29.
Hai Huong Seafood Joint Stock Company challenging the final results of an antidumping duty new shipper review on frozen fish fillets from Vietnam. #16-00141. Filed July 29.
​Appeals of CIT Decisions
The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of July 25-31:
Chemtall appealing a CIT decision issued May 25 that found a chemical it imported is not an amide, but is instead a derivative of an amide, even though it underwent no process to transform it from an amide (see 1605260031). CIT ruled CBP was correct in classifying the chemical under subheading 2924.19.80, which has a 6.5% duty rate. Chemtall had originally classified its acrylamide tertiary butyl sulfonic acid (ATBS) as an amide under subheading 2924.19.11, dutiable at 3.7%. #16-2380. Filed July 25.
