Treasury Dept. Fall Regulatory Agenda for CBP Includes Customs Reauthorization Rulemakings

The Treasury Department published its fall 2016 regulatory agenda for CBP (here), which mentions new rulemakings that implement part of the customs reauthorization. The agenda includes first mentions of an increase to the de minimis value (here) and antidumping and countervailing duty evasion investigation procedures (here). While interim final rules on both were issued earlier this year, CBP sought public comments on each, so further changes may be included when the regulations are finalized. CBP is aiming to finish the AD/CV duty evasion rulemaking (see 1608190014) by March, and the de minimis rulemaking (see 1608250029) by April, it said.

Also included in the agenda are rulemakings related to the ACE transition. The agenda now mentions CBP's (see 1609290029) proposal to allow electronic notices of arrival for goods regulated by the Environmental Protection Agency (here). It also includes CBP's proposal to allow for electronic filing of engine emission standards data (see 1608160015) required by the CBP (here). It lists December as the target date for the changes. The agency's proposal to update CBP's regulations under the Toxic Substances Control Act to provide for electronic filing (see 1608260032) is also now in the agenda (here). CBP aims to complete that rulemaking in December as well, it said. A previously mentioned rulemaking (see 1605230009) to end hybrid filings -- entry filings in both electronic and paper formats -- is no longer included. Since announcing initial plans to end hybrid filing, CBP has moved away from the idea (see 1607270040).

The agenda lists Treasury's CBP rulemakings that are pending at the proposed, interim final, final and completed stages, as well as rulemakings that are long-term actions. The agenda lists the regulation title; past regulation(s), if any; the time frame for the next regulatory action(s), if any; a brief description of the regulation; and a contact party name and telephone number.
