In Zone Brands, challenging CBP's classification of its toy character toppers. CBP classified the merchandise in HTS subheading 3923.50.0000 (5.3%). In Zone said it should be classified in subheading 9503.00.0090 (free). #17-027. Filed Feb. 6.
Hartford Fire Insurance, challenging CBP claims on bonds covering entries of garlic. Hartford says the claims should be canceled because the bonds had errors. #17-028. Filed Feb. 7.
U.S. government, seeking $238,516.56 in unpaid duties and a $3,232,032 penalty from Greenlight Organic for fraudulent violations of 19 USC 1592(a). The government says Greenlight intentionally misclassified its imported apparel to obtain a lower duty rate, and intentionally and improperly deducted freight and insurance charges from the value of the merchandise. #17-031. Filed Feb. 8.
​Appeals of CIT Decisions
The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Feb. 6-12:
Harmoni International, appealing a Feb. 7 CIT decision. Though the decision is not yet public, Harmoni had challenged CBP's decision to require single transaction bonds on its entries of fresh garlic from China. #17-1600. Filed Feb. 7.
