BIS Final Rule Amends EAR Language on Dual-Use Goods Pursuant to Wassenaar Arrangement
The Bureau of Industry and Security is issuing a final rule to align the Commerce Control List (CCL) and Export Administration Regulations (EAR) with changes made to the Wassenaar Arrangement’s List of Dual-Use Goods and Technologies during the December 2016 Wassenaar Plenary Meeting, BIS said. Eight export control classification numbers (ECCNs) in CCL Category 3 (electronics) were revised, more than in any other category. There will be revisions to 50 ECCNs in total, BIS said. Among the changes is the addition of "Monolithic Microwave Integrated Circuits" (MMICs) to the list of integrated circuits in the note to ECCN 3A001.a, covering general-purpose integrated circuits.

BIS is also adding ECCN 3A001.b.12, "transmit/receive modules, transmit/receive MMICs, transmit modules, and transmit MMICs," and making that item eligible for the shipments of limited value license exception (LVS). The agency is also adding 3A001.a.14 "to control integrated circuits that perform the same functionality of electronic assemblies, modules, or equipment described in paragraph 3A002.h," BIS said. 3A001.a.14 will enjoy BIS's "GBS" license exception for shipments to nations in the less restricted "Country Group B." BIS is also expanding the availability of the TSR (technology and software restricted) and STA (strategic trade authorization) license exceptions for ECCNs 4D001 (software) and 4E001 (technology). Effective Nov. 24, BIS is also relaxing export restrictions to Myanmar for computers, their assemblies, and "specially designed" components, pursuant to an Oct. 7, 2016, executive order ending the U.S. national emergency on the country (see 1610110029).
