Recent AD/CV Scope Ruling Requests

The following new requests for antidumping and countervailing duty scope rulings were filed with the Commerce Department since International Trade Today's last update:​

Steel Nails from China (A-570-909). Indian Mill Construction Supply, seeking a scope ruling that its twist lock screws, imported for use in the company’s Pin-Lok and Pin-Lam scaffolding plank systems, are not covered by antidumping duties because they are not nails and are driven into boards by turning them. Filed Oct. 4.

Aluminum Extrusions from China (A-570-967/C-570-968). Valterra Products requests a ruling that its aluminum telescopic swimming pool poles are finished goods exempt from the AD/CV duty orders. Filed Sept. 27.

Malleable Cast Iron Pipe Fittings from China (A-570-881). Steel Electric Products Company asks that Commerce issue a ruling that its electrical conduit fittings are not covered by AD duties. Filed Sept. 27.

Large Residential Washers from China (A-570-033). The Army & Air Force Exchange Service requests Commerce find its washers are outside the scope of AD duties because they have a vertical rotational axis, are top loading, and have a drive train consisting of a permanent split capacitor motor, a belt drive and a flat wrap spring clutch. Filed Sept. 25.

Wooden Bedroom Furniture from China (A-570-890). Homewerks Worldwide asks that Commerce find its bathroom storage units are not covered by AD duties because they are part of a coordinated bathroom, not bedroom, set. Filed Sept. 21.

Pasta from Italy (A-475-818/C-475-819). European Importers requests a scope ruling that its gnocchi potato dumplings are not covered by AD/CV duties because the scope of the orders is limited to dry pasta. Filed Sept. 17.

Artist Canvas from China (A-570-899). Impact Images asks that Commerce rule its polyester fabric coated with flame-retardant and polyurethane for the manufacture of instant canopies is not covered by AD duties because it is not coated with gesso. Filed Aug. 29.

Non-Malleable Cast Iron Pipe Fittings from China (A-570-875). MCC Holdings, dba Crane Resistoflex, seeks a scope ruling that its ductile iron lap joint flanges are not within the scope of AD duties because they are flanges, not fittings. Filed Aug. 29.

Circular Welded Carbon Steel Pipes and Tubes from Thailand (A-549-502). BM Metals asks that Commerce find its fire protection pipe is not covered by AD duties because it is not understood by industry to be standard pipe or structural tubing and is specifically produced for use in fire sprinkler systems and not for general fluid, air and structural applications. Filed Aug. 28.

Carbon Steel Butt-Weld Pipe Fittings from China (A-570-814). Smith-Cooper International requests that Commerce find its Cooplet welded outlets are not subject to AD duties because they use a weaker fillet weld, not a butt-weld, on one end; use threading or a groove on the other end; are machined, not formed or forged; are used exclusively in low-pressure fire sprinkler systems; and are not shaped to allow for an end-to-end, bevel-to-bevel weld. Filed Aug. 13.

Aluminum Extrusions from China (A-570-967/C-570-968). AIRpipe USA requests a ruling that its pipe, fittings and accessories for compressed air and inert gas piping systems are not subject to AD/CV duties because they are in many cases die cast, not extruded, and are otherwise manufactured to quality specifications needed to handle compressed air and gas. Filed July 24.

Aluminum Extrusions from China (A-570-967/C-570-968). AMQ Solutions asks that Commerce find its ILINE workstation kits are finished goods kits exempt from AD/CV duties. Filed July 17.

Steel Nails from China (A-570-909). Roy G. Evans Co., dba Evco, requests Commerce find its metal skirting spikes and metal skirting spike kits are not covered by the scope of AD duties because they are not nails. Filed July 13.
