May 20 CBP Bulletin Proposes to Revoke Ruling on Alloy Steel Pipes

In the May 20 Customs Bulletin (Vol. 54, No. 19), CBP published notices that propose to revoke rulings and similar treatment for wireless speakers.

Comments on Proposals Due June 19

CBP said consideration will be given to any written comments received by June 19 before taking this action. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Alloy Steel Pipes

Item: Alloy steel pipes
Current: 7304.59.2055, 7304.59.2060, and 7304.59.2070, Free, “Other tubes and pipes suitable for use in boilers, superheaters, etc. broken out by wall diameter.”
Proposed: 7304.59.2030, Free, “Tubes, pipes and hollow profiles, seamless, of iron (other than cast iron) or steel: Other, of circular cross section, of other alloy steel: Other: Other: Suitable for use in boilers, superheaters, heat exchangers, condensers, refining furnaces and feedwater heaters: Of heat-resisting steel.”
Reason: CBP said the pipes are not classifiable in the “other” than heat-resisting steel subheadings of 7304.59.2055, 7304.59.2060, or 7304.59.2070. The pipes meet the industry standard and definition for heat-resisting steel. “The properties of the pipes indicate that the products are actually, practically, and commercially fit for use in boilers, etc., and that even if the products are not chiefly used in that way, there is more than evidence of a casual, incidental, exceptional, or possible use,” CBP said.
