Canada Softwood Lumber: CV Duty Exemption Ends for 5 Companies

Five Canadian softwood lumber exporters will, effective Aug. 28, be newly subject to countervailing duty cash deposit requirements on softwood lumber from Canada (C-122-858), the Commerce Department said.

Implementing a recent Court of International Trade decision that vacated an “expedited review” completed in 2019 (see 1907030015), Commerce said the zero rates and consequent CV duty exemptions it set in the review for Les Produits Forestiers D&G Ltee, Marcel Lauzon Inc., North American Forest Products Ltd., Roland Boulanger & Cie Ltee and Scierie Alexandre Lemay & Fils Inc. are no longer valid, and each company will now become subject to CV duty suspension of liquidation and cash deposit requirements at the “all others” rate. CIT ruled Commerce has no legal authority to conduct expedited reviews.

Commerce, effective Aug. 28, will apply CV duties at the following rates to companies that were subject to the now-vacated expedited review:
