China Kegs: Prelim Results of AD Admin Review

The Commerce Department has issued the preliminary results of its antidumping duty administrative review on refillable stainless steel kegs (kegs) from China (A-570-093). The agency preliminarily assigned the mandatory respondent, Guangzhou Ulix Industrial & Trading Co., Ltd., a zero percent AD rate. If this rate is confirmed in the final results, Commerce would not assess AD duties for subject merchandise from Ulix entered between Dec. 13, 2019, and Nov. 30, 2020.

Commerce has ordered liquidation “as entered” at the cash deposit rate in effect at the time of entry for subject merchandise entered Dec. 13, 2019, and Nov. 30, 2020, that was exported by companies for which a review was not requested, i.e., all but Ulix (ADD/CVD Message # 1071405).

AD Duty Cash Deposit Requirements

Once Commerce issues its final results, new AD duty cash deposit requirements may take effect for some companies, beginning on the date of publication of the final results in the Federal Register. Commerce preliminarily calculated the following AD duty cash deposit rates:

No shipments. Commerce also preliminarily determined that Guangzhou Jingye Machinery Co., Ltd. had no shipments of subject merchandise during the review period. If the no shipments determination is upheld in the final results, subject merchandise entered using Jingye's case number will be liquidated at the China-wide rate, currently 77.13%.

China-wide entity. Commerce preliminarily found 28 companies did not demonstrate independence from state control and are part of the China-wide entity, with a rate of 77.13%. These companies for which a review was requested (none of which filed a separate rate application) are: Equipmentimes (Dalian) E-Commerce Co., Ltd.; Jinan HaoLu Machinery Equipment Co., Ltd.; NDL Keg Qingdao Inc.; Ningbo BestFriends Beverage Containers Industry Co., Ltd.; Ningbo Chance International Trade Co., Ltd.; Ningbo Direct Import & Export Co., Ltd.; Ningbo Haishu Direct Import and Export Trade Co., Ltd.; Ningbo Haishu Xiangsheng Metal Factory; Ningbo Hefeng Container Manufacturer Co., Ltd.; Ningbo Hefeng Kitchen Utensils Manufacture Co., Ltd.; Ningbo HGM Food Machinery Co., Ltd.; Ningbo Jiangbei Bei Fu Industry and Trade Co., Ltd.; Ningbo Kegco International Trade Co., Ltd.; Ningbo Minke Import & Export Co., Ltd.; Ningbo Sanfino Import & Export Co., Ltd.; Ningbo Shimaotong International Co., Ltd.;. Ningbo Sunburst International Trading Co., Ltd.; Orient Equipment (Taizhou) Co., Ltd.; Penglai Jinfu Stainless Steel Products; Qingdao Henka Precision Technology Co., Ltd.; Rain Star International Trading Dalian Co., Ltd.; Shandong Tiantai Beer Equipment Co., Ltd.; Shandong Tonsen Equipment Co., Ltd.; Sino Dragon Group, Ltd.; Wenzhou Deli Machinery Equipment Co.; Wuxi Taihu Lamps and Lanterns Co., Ltd.; Yantai Toptech Ltd.; and Yantai Trano New Material Co., Ltd.

For all Chinese exporters of subject merchandise that have not been found to be entitled to a separate rate, the cash deposit rate will be that for the China-wide entity. For all non-Chinese exporters of subject merchandise that have not received their own rate, the cash deposit rate will be the rate applicable to the Chinese exporter that supplied that non-Chinese exporter.

Assessment Rates

If these preliminary results are confirmed in the final results, importers of subject merchandise exported by Ulix during the period Dec. 13, 2019, through Nov. 30, 2020, will not be assessed AD duties, and importers from the other companies under review will be assessed AD duties at the rate listed above.
