Updated OFAC FAQ Adds to HTS Numbers Covered by Russia Seafood Ban

The Office of Foreign Assets Control on Jan. 18 updated guidance related to an expanded ban on imports of Russian seafood announced in December (see 2312220007). The update to OFAC’s frequently asked question adds several new tariff subheadings to the lists of tariff provisions for pollock and other seafood to which the ban may apply.

Specifically for pollock, the updated FAQ adds subheadings 0302.55.1100, 0302.55.5000, 0302.59.5010, 0303.67.0000, 0304.44.0025, 0304.75.1000, 0304.75.5000, 0304.79.1010, 0304.94.1005, 0304.94.1010, 0304.94.1090, 0304.94.9000, 0304.95.1030, 0305.69.1022 and 0305.69.1042.

It also adds new subheadings to the list of subheadings that may apply to banned salmon, cod, pollack and crab: 0302.59.1100, 0304.95.1005, 0304.95.1090, 0304.99.1104, 0304.99.1109, 0304.99.1183, 0305.39.6180, 0305.49.4045, 0305.59.0001.

OFAC continued to say that it “anticipates publishing regulations defining these terms to include articles defined” in the tariff schedule subheadings listed in the FAQ.

As announced by the White House in December, the expanded ban now covers seafood caught in Russian waters or by Russia's fishing fleet but processed elsewhere, including in China. It also similarly expands the ban on Russian diamonds to those incorporated into other products in third countries.
