Malaysia Utility Scale Wind Towers: Prelim Results of CVD Admin Review

The Commerce Department has published the preliminary results of its countervailing duty administrative review on utility scale wind towers from Malaysia (C-557-822). This review covers subject merchandise from the exporters under review entered during calendar year 2022.

The review began with respect to 12 companies, with CS Wind Malaysia Sdn. Bhd. selected as the mandatory respondent. Commerce then found that 11 companies had no reviewable shipments during the review period: CS Wind Corporation; CS Wind China Co., Ltd; CS Wind Taiwan Ltd; CS Wind Turkey Kule Imaltati A.S; CS Wind UK Limited; CS Wind Vietnam Co., Ltd; CS Wind Portugal, S.A.; GE Renewable Energy; GE Renewable Malaysia Sdn. Bhd; Nordex SE; and Siemens Gamesa Renewable Energy. With no comments as to why the review should not be rescinded for any of these, Commerce said it's ending the review for the 11 companies.

Only the exporters for which an administrative review was requested are covered by this review. Cash deposit rates for all other exporters will not change. Commerce has ordered liquidation “as entered” for entries during the period of review from all exporters for which a review was not requested or review requests were withdrawn (ADCVDWeb Message # 3326423).

Cash Deposit Requirements

New CVD cash deposit requirements may take effect for the following company beginning on the date of publication of the final results in the Federal Register, currently scheduled for January. Commerce preliminarily calculated the following CVD cash deposit rate:

Commerce intends to instruct CBP to collect cash deposits of estimated countervailing duties in the amount indicated for CS Wind Malaysia Sdn. Bhd. on shipments of subject merchandise entered, or withdrawn from warehouse, for consumption on or after the date of publication of the final results of this review.
