Thermoformed Molded Fiber: CVD Cash Deposit Rates Take Effect for China, Vietnam

The Commerce Department is setting new countervailing duty cash deposit requirements for imports of thermoformed molded fiber products from China (C-570-183) and Vietnam (C-552-846), after finding illegal subsidization of producers in both countries in the preliminary determinations of its CVD investigations. Suspension of liquidation and cash deposit requirements take effect for Chinese companies March 14, and for Vietnamese companies they take retroactive effect Dec. 14.

Commerce is also conducting concurrent antidumping duty investigations on thermoformed molded fiber products from China and Vietnam, with its preliminary AD duty determinations due May 6.

Commerce Finds Critical Circumstances for Some; Cash Deposits Retroactive 90 Days

Commerce made a finding that all Vietnamese companies increased their exports of thermoformed molded fiber products to the U.S. in the run-up to the preliminary determination. This "critical circumstances" finding by the agency means Commerce will retroactively suspend liquidation for all Vietnamese companies back to 90 days before the preliminary determination, i.e., Dec. 14.

Commerce made no such finding for Chinese companies, so suspension of liquidation will take effect on the preliminary determination's publication date of March 14.

CV Suspension of Liquidation and Cash Deposit Requirements

Commerce says it will instruct CBP to suspend liquidation for all entries of subject merchandise that are entered, or withdrawn from warehouse, for consumption on or after the dates listed below. Preliminary CV cash deposit rates will be required as follows:
