USP Holdings, Inc., challenging CBP's denial of its protest claiming it was improperly denied Section 232 exclusions for its steel entries. # 25-00227. Filed Oct. 14.

Gladway Company, challenging CBP's denial of its protest claiming its food storage containers of Harmonized Tariff Schedule subheading 3923.90.0080, dutiable at 3%, and secondary subheading 9903.88.03, which comes with a 25% Section 301 duty, should be classified under subheading 3924.10.4000, dutiable at 3.4%. # 25-00228. Veregy Central, LLC, challenging CBP's assessment of antidumping and countervailing duties on its four entries of solar modules from Thailand and Vietnam. # 25-00229. Filed Oct. 17.

Camel Energy, Inc., challenging CBP's denial of its protest claiming the agency unlawfully excluded its lead-acid batteries from Malaysia under the Uyghur Forced Labor Prevention Act. # 25-00230. Filed Oct. 24.

Bay Brokerage Inc., challenging CBP's denial of its protest claiming its entries of Ford Edge, Land Rover and Chevrolet Silverado cars of Harmonized Tariff Schedule subheadings 8703.24.0190, 8704.31.0140 and 9801.00.1066 were deemed liquidated without application of the proper duties. # 25-00231. Bay Brokerage Inc., challenging CBP's denial of its protest claiming its entries of Chevrolet Silverado vehicles of Harmonized Tariff Schedule subheading 8704.31.0140 were deemed liquidated without application of the proper duties. # 25-00232. Filed Oct. 24.

Appeals of CIT Decisions

The following appeals of a Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the weeks of Oct. 13-19 and 20-26:

BASF Corporation, appealing an August CIT decision finding the company's Betatene is properly classified under Harmonized Tariff Schedule subheading 2106.90.99 as a dietary supplement. # 26-1056. Opened Oct. 15.

Galleher Corp. and Galleher, LLC, appealing an August 2022 CIT decision remanding various elements of the Commerce Department's 2017 review of the countervailing duty order on multilayered wood flooring from China. # 26-1050. Opened Oct. 15.

United States, appealing an August CIT decision vacating the Commerce Department's decision not to collect antidumping and countervailing duties on solar cells from Cambodia, Malaysia, Thailand and Vietnam. # 26-1072. Opened Oct. 21.

Kumho Tire (Vietnam) Co., Ltd., appealing an August CIT decision sustaining the Commerce Department's countervailing duty investigation on passenger vehicle and light truck tires from Vietnam in which the agency countervailed Vietnamese currency undervaluation. # 26-1089. Opened Oct. 24.
