China Solar Cells: Final Results of AD Admin Review

The Commerce Department has released the final results of the antidumping duty administrative review on crystalline silicon photovoltaic cells from China (A-570-979). These final results will be used to set final assessments of AD on importers for subject merchandise entered December 2022 through November 2023.

Commerce continued from its preliminary results the finding that Jinko Solar (single entity consisting of Jinko Solar Import and Export Co., Ltd.; Jinko Solar Co., Ltd.; JinkoSolar Technology (Haining) Co., Ltd.; Yuhuan Jinko Solar Co., Ltd.; Zhejiang Jinko Solar Co., Ltd.; Jiangsu Jinko Tiansheng Solar Co., Ltd.; JinkoSolar (Chuzhou) Co., Ltd.; JinkoSolar (Yiwu) Co., Ltd.; and JinkoSolar (Shangrao) Co., Ltd.), Longi Solar Technology Co. Ltd., and Zhejiang Aiko Solar Energy Technology Co., Ltd. had no shipments during the review period. The agency rescinded, as it preliminarily determined it would, the review for one company, Red Sun Energy Long An Company Limited, because it had no suspended entries of subject merchandise during the review period.

New Cash Deposit Rates Effective Dec. 23

For entries on or after Dec. 23, the date these final results are to be published in the Federal Register, Commerce is setting new AD cash deposit rates for the companies under review. For any other exporters of subject merchandise that were not under review (i.e., all exporters of subject merchandise except those listed below), cash deposit rates will remain at the level set in the most recent review of each respective company. For companies that have never been assigned a cash deposit rate by Commerce, the China-wide rate applies. The new rates are as follows:

No shipments. The cash deposit rates currently in effect for these three companies -- Jinko Solar, Longi Solar and Zhejiang Aiko -- will not change, and any entries during the period of review reported under their case numbers will be assessed duties at the 238.95% China-wide rate.

China-wide. Commerce said there are 34 companies -- see Appendix II for the complete list -- in the review that are part of the China-wide entity and don't get a separate rate, based on their status as being government-controlled companies. It noted that the list is different from the list published in the preliminary results notice, with some subtracted in the final results. The agency also assigned the China-wide AD rate of 238.95% to Anji DaSol Solar Energy Science & Technology Co., Ltd., because it declined to grant it a separate rate.

Assessment Rates for Entries December 2022 - November 2023

Commerce is using the rates it calculated in these final results to set assessments of AD on importers of subject merchandise for entries between Dec. 1, 2022, and Nov. 30, 2023. Commerce will assess AD on entries from Shenzhen Sungold Solar at importer-specific rates. Importers of subject merchandise from the other companies under review will be assessed AD at the rates listed above.
