ITC Begins Section 337 Investigation on Invisalign Products

The International Trade Commission began a Section 337 investigation on allegations that U.S. company USA Angelalign Technology Corp., two Chinese companies and their subsidiaries are importing and selling retainers that infringe patents held by Align Technologies (ITC Inv. No. 337-TA-1471), it said in a notice to be published Dec. 29.

The complaint was filed in November and seeks a limited exclusion order and cease and desist orders against the respondents to bar from entry "certain clear aligners and components thereof" that violate the complainants' patents (see 2511180025).

Align said in the complaint that its product Invisalign "is a series of clear aligners that patients swap out periodically to gradually re-align their teeth."
