EPA to Propose Action to Reduce Unreasonable Risk of 1,3-Butadiene

EPA says it is planning to propose a "risk management regulatory action" to address its finding that 1,3-butadiene presents an unreasonable risk of injury to health or the environment, according to a Federal Register notice.

"EPA expects to focus its risk management action on the conditions of use that significantly contribute to the unreasonable risk," the agency said. Taking this action is consistent with section 6(a) of the Toxic Substances Control Act, EPA said.

In December 2019, EPA had designated 1,3-butadiene as a high-priority chemical substance for risk evaluation under the TSCA. Following a public comment period on a draft risk evaluation in April 2020 and a final scope in September 2020, EPA released a draft risk evaluation for public comment and external peer review by the Science Advisory Committee on Chemicals in December 2024. The TSCA required EPA to conduct a risk evaluation (see 1701190016).

Through these analyses, as well as public input, EPA determined that 1,3-butadiene, under certain conditions of use (COUs), presents an unreasonable risk of injury to human health, according to this week's Federal Register notice. One of these COUs occurs in manufacturing and importing 1,3-butadiene.

As a result of these findings, EPA will propose a risk management regulatory action so that 1,3-butadiene no longer presents an unreasonable risk, the agency said.
