The Commerce Department made preliminary affirmative antidumping duty determinations that imports of melamine from Germany (A-428-852), India (A-533-924), Japan (A-588-882), the Netherlands (A-421-817) and Trinidad and Tobago (A-274-810) are being sold in the U.S. at less than fair value. The agency will generally impose AD cash deposit requirements on entries of subject merchandise beginning on Sept. 24, 2024, though cash deposit requirements take effect retroactively for all some Indian, Japanese and Trinidadian companies, beginning on June 26, 2024.

A phone company may be held liable for illegal robocalls transmitted over its network, a federal court ruled Thursday. Partly granting Florida’s motion for summary judgment, the U.S. District Court of Southern Florida found that Smartbiz Telecom violated the Truth in Caller ID Act and the Telemarketing Sales Rule (TSR). While the court will move to trial on Florida’s additional counts alleging Telephone Consumer Protection Act (TCPA) violations, Judge Jose Martinez disagreed with Smartbiz, which, as an intermediate provider that didn't initiate the calls, argued it can't be held liable under the TCPA. Smartbiz, Martinez wrote, "was involved in the placing of the telephone calls because it knowingly allowed fraudulent calls to transit its network.”

The Commerce Department began administrative reviews for certain firms subject to antidumping and countervailing duty orders with August anniversary dates. Producers and exporters subject to any of these administrative reviews on China or Vietnam must submit their separate rate certifications or applications on or about Oct. 21 to avoid being assigned high China-wide or Vietnam-wide rates.

The Commerce Department has published the preliminary results of its antidumping and countervailing duty administrative reviews of finished carbon steel flanges from India (A-533-871/C-533-872). In the final results of this review, Commerce will set AD assessment rates for subject merchandise for the companies under review entered Aug. 1, 2022, through July 31, 2023, and CVD assessment rates for entries Jan. 1, 2022, through Dec. 31, 2022.
