Three top House Commerce Committee Democrats said Wednesday they're opening an investigation into reports that mobile virtual network operator Trump Mobile (see 2506160040) would operate on T-Mobile’s network, claiming that “raises the appearance of a quid pro quo between [the carrier] and President [Donald] Trump regarding the direction of our country’s spectrum policies.” Word of the probe came as T-Mobile announced it once again was the U.S. wireless industry leader on subscriber growth in Q2 (see 2507230066)
House Communications Subcommittee ranking member Doris Matsui of California and 21 other Democratic lawmakers told Commerce Secretary Howard Lutnick on Tuesday that they have “deep concerns” about NTIA’s updated policy notice for the $42.5 billion BEAD program, which reversed much of what the Biden administration developed in the initiative’s initial rules (see 2506060052). NTIA said Monday it had approved updated BEAD plans for all 56 states and territories, setting up a Sept. 4 deadline for governments to submit a final proposal with the results of at least one round of a mandated “Benefit of the Bargain” subgrantee section process (see 2507210061).
President Donald Trump on Friday hailed the House’s passage (see 2507170045) just after midnight of a Senate-amended version of the 2025 Rescissions Act (HR-4), which includes a clawback of $1.1 billion in advance CPB funding for FY 2026 and FY 2027. As expected, the House voted for HR-4 216-213, with only two Republicans -- Reps. Brian Fitzpatrick of Pennsylvania and Mike Turner of Ohio -- joining Democrats against the measure. Several Democratic leaders and other advocates predicted dire consequences for many local public broadcasters.
Leaders of the House and Senate Commerce committees who are spearheading the bipartisan congressional working group on a USF legislative revamp, which relaunched in June (see 2506120091), told us they plan to begin meeting again this month. But they said they feel less pressure to quickly reach an agreement on legislative recommendations since the U.S. Supreme Court's recent ruling in Consumers’ Research v. FCC, which found that USF’s funding mechanism is constitutional (see 2506270054). Sens. Ben Ray Lujan, D-N.M., and John Thune, R-S.D., formed the working group in 2023 as Communications Subcommittee chairman and ranking member, respectively (see 2305110066).
House action on the Senate-cleared version of the HR-1 budget reconciliation package, previously known as the One Big Beautiful Bill Act, appeared in doubt Wednesday afternoon amid resistance from several GOP lawmakers. Critics of Senate Commerce Committee Republicans’ HR-1 spectrum language held out hope amid the ruckus that lawmakers would make additional bands ineligible for potential reallocation. The Senate narrowly passed its HR-1 language Tuesday (see 2507010070).
The U.S. Supreme Court upheld the FCC’s USF contribution scheme in a 6-3 opinion Friday in Consumers’ Research v. FCC, but dissenting and concurring opinions from several conservative justices appeared to invite future challenges, attorneys told us.
The leaders of the House and Senate Communications subcommittees said Thursday they're reviving the bicameral USF revamp working group, which had paused its work on legislative recommendations last year amid uncertainty following the 5th U.S. Circuit Court of Appeals’ ruling in the Consumers' Research lawsuit against the program’s funding mechanism (see 2407300053). The Supreme Court heard oral arguments for its review of the case in March (see 2503260061). Working group members had considered melding the FCC’s lapsed affordable connectivity program with USF’s Lifeline program and keeping the latter’s narrower eligibility rules (see 2404170066).
Senate Commerce Committee ranking member Maria Cantwell, D-Wash., continued Thursday to criticize panel Republicans’ proposed spectrum language for the chamber’s budget reconciliation package (see 2506060029). She argued during a Center for Strategic and International Studies event that the spectrum proposal would leave DOD and aviation stakeholders more vulnerable to China and other malicious actors. House Communications Subcommittee ranking member Doris Matsui of California and 30 other chamber Democrats also urged Senate leaders to jettison language from the reconciliation package that would require governments receiving funding from the $42.5 billion BEAD program to pause enforcing state-level AI rules.
The House Rules Committee was still considering Tuesday whether to allow floor votes on a pair of Democratic amendments to the 2025 Rescissions Act (HR-4) that would strip out its proposed clawback of $1.1 billion of CPB’s advance funding for FY 2026 and FY 2027 (see 2506090036). Panel Republicans and Democrats sparred over CPB funding during the hearing, reflecting growing GOP interest in revoking federal support for public broadcasters over claims that their content has a predominantly pro-Democratic bias (see 2503210040). Meanwhile, Sen. Mike Rounds, R-S.D., told us he's still undecided about supporting a CPB funding rollback once the upper chamber considers HR-4.
Rep. Dan Goldman, D-N.Y., co-chairman of the Congressional Public Broadcasting Caucus, is seeking to strip out a proposal to claw back CPB’s $1.1 billion in advance funding for FY 2026 and FY 2027 from the 2025 Rescissions Act (HR-4). The lower chamber moves toward GOP leaders’ expected push to pass the measure this week (see 2506030065). Meanwhile, the U.S. District Court for the District of Columbia on Sunday rejected a preliminary injunction request from a trio of CPB board members who are challenging Trump’s disputed April move to fire them (see 2504290067).
