The Bureau of Industry and Security reports that Boniface Ibe of Maryland has been sentenced to five months in prison followed by 10 months of supervised release for attempting to export certain arms to Nigeria without a license, and for delivering a firearm to a common carrier without written notice.
The Bureau of Industry and Security has issued a final rule, effective July 12, 2011, which amends the Export Administration Regulations (EAR) at Supplement No.7 to 15 CFR Part 748 - Authorization Validated End-User (VEU): List of Validated End-Users, Respective Items Eligible for Export, Reexport and Transfer, and Eligible Destinations to add a column that lists Federal Register citations for the respective entries. BIS notes that its rule does not make any substantive changes to Supplement No. 7 or elsewhere in the EAR.
On July 8, 2011, the Bureau of Industry and Security announced that Xun Wang, a former managing director of PPG Paints Trading Co., Ltd., has been indicted on a charge of conspiring to and causing the export and reexport of high performance coatings to a nuclear reactor in Pakistan owned by an entity on the Entity List, and other related offenses, in violation of the International Emergency Economic Powers Act and the Export Administration Regulations.
The Bureau of Industry and Security has issued a final rule, effective July 11, 2011, which makes several technical amendments to the Export Administration Regulations, including correcting one omission of a publication date in the authority citation paragraph of 15 CFR Part 730; revising the address of the Western Regional Office; updating the table of authorized information collection control numbers in Supplement No. 1 to 15 CFR Part 730 to reflect consolidation of several authorizations relating to license exceptions and exclusions into a single authorization with a single control number; and removing a requirement to report to BIS certain exports of oil transported from the North Slope of Alaska over Federal rights-of-way granted pursuant to section 203 of the Trans-Alaska Pipeline Authorization Act (as BIS can now obtain this information from the Automated Export System (AES)).
The Bureau of Industry and Security has issued a final rule, effective July 9, 2011, which amends the Export Administration Regulations (EAR) to add certain controls on exports and reexports of U.S.-origin dual-use items to a new nation, the Republic of South Sudan, which has voted to become a separate nation from Sudan1.
The Bureau of Industry and Security is amending its Temporary Denial Order (TDO) denying the export privileges of Mahan Airways, Gatewick LLC, Pejman Mahmood Kosarayanifard, and Mahmoud Amini to add the following additional respondent in order to prevent an imminent violation of the TDO: Zarand Aviation aka GIE Zarand Aviation of France. The order is currently in effect until August 24, 2011, unless renewed.
The Bureau of Industry and Security has issued an order denying certain export privileges for a period of five years and imposing a civil penalty of $15,000 against Eric Cohen for his involvement with the export of thermal imaging cameras from the U.S. to Komeco Co., Ltd., in South Korea, without the required Department of Commerce license, in violation of the Export Administration Regulations. The thermal imaging cameras are classified under Export Control Classification Number (ECCN') 6A003.b.4, and are controlled for reasons of regional stability (RS).
The Bureau of Industry and Security has announced that the Information Systems Technical Advisory Committee (ISTAC) will hold a partially open meeting on July 27 and 28, 2011. The agenda for the public session includes discussion of the Wassenaar proposals for 2012 and industry presentations on coherent optical technologies, graphics processors, and 60 GHz MMIC applications. The open session will be accessible via teleconference to 20 participants on a first come, first serve basis. The Directorate of Defense Trade Controls has posted the May 3, 2011 Defense Trade Advisory Group Plenary minutes. Among other things, DTAG officials discussed tiering criteria for Tiers 2 and 3 of the U.S. Munitions List (USML), license exemptions under the International Traffic in Arms Regulations (ITAR), and the Government Program License for all U.S. government acquisition programs. A DDTC official also gave a presentation on the agency's draft definition of the term "specially designed."
