The Department of Defense has issued a final rule, effective June 6, 2011, which amends the Defense Federal Acquisition Regulation Supplement (DFARS) to correct several anomalies resulting from recent changes relating to source of ball and roller bearing components, eligibility of Peruvian end products under trade agreements, and participation of foreign contractors in acquisitions in support of operations in Afghanistan.
The Department of Defense has issued a proposed rule to amend the definition of “qualifying country end product” by eliminating the component test for qualifying country end products that are commercially available off-the-shelf items under the Defense Acquisition Regulations System. Comments are due by August 5, 2011.
As part of its implementation of Executive Order 13563, "Improving Regulation and Regulatory Review," the Department of Defense is seeking comments and information from interested parties to assist DoD in reviewing its existing regulations to determine whether any such regulations should be modified, streamlined, expanded, or repealed. Comments are due by July 6, 2011.
The Directorate of Defense Trade Controls announces that effective June 3, 2011 applicants must download and use the updated DS-4076 Version 1.1 (Commodity Jurisdiction (CJ) Determination Request Form). All prior versions will be rejected. Applicants are advised to always use the current version on-line versus saving a copy to their desktop and re-using it. The updated version is available here. The Office of Management and Budget has approved the Bureau of Industry and Security's final rule entitled: "Export Control Modernization: Strategic Trade Authorization License Exception." The International Trade Administration is seeking nominations of individuals for consideration for appointment by the Secretary of Commerce to serve as members of one of the 60 District Export Councils (DECs) nationwide. DECs are closely affiliated with the U.S. Export Assistance Centers of the U.S. and Foreign Commercial Service, and play a key role in the planning and coordination of export activities for their communities. Nominations must be received by close of business on July 15, 2011.
The Bureau of Industry and Security is correcting the meeting time and agenda for the June 9, 2011 meeting of the President's Export Council Subcommittee on Export Administration. The time of the meeting is corrected from 9:00 a.m. to 10:00 a.m., and the agenda for the open session no longer includes an export control reform update as previously indicated.
The Bureau of Industry and Security has reminded industry that all Simplified Network Application Processing-Redesign (SNAP-R) account holders with at least one active SNAP-R account must designate an administrator by June 9, 2011. After this date, all active SNAP-R user accounts associated to the company CIN without a designated company administrator will become inactive until at least one company administrator is designated.
